Overtime rules in Florida
At Florida's $15.00 minimum wage, five 10-hour days pay at least $825.00: 40 hours at straight time and 10 at $22.50. Florida has no overtime law of its own, so the federal 40-hour rule is the whole answer. What Florida sets is the minimum wage, and that sets the floor under every overtime hour.
| A week at the $15 minimum | Overtime hours | Least it can pay | Tipped: least cash wages |
|---|---|---|---|
| Four 10-hour days, 40 hours | 0 | $600.00 | $479.20 |
| Five 9-hour days, 45 hours | 5 | $712.50 | $576.60 |
| Five 10-hour days, 50 hours | 10 | $825.00 | $674.00 |
| Five 11-hour days, 55 hours | 15 | $937.50 | $771.40 |
| Six 10-hour days, 60 hours | 20 | $1,050.00 | $868.80 |
Only the week counts
Neither Florida nor federal law pays daily overtime, so four 10-hour days are 40 hours at straight time. Overtime starts with the 41st hour in the workweek, a fixed run of seven consecutive days that your employer sets. Each workweek stands alone: 50 hours followed by 30 is still 10 hours of overtime, whatever the biweekly check says.
The new minimum wage
Florida's minimum wage rose to $15.00 on September 30, 2026, which makes $22.50 the lowest legal overtime rate in the state. Tipped workers can be paid a cash wage of $11.98, but their overtime is still figured on the full $15.00: each overtime hour owes $19.48 in cash, not one and a half times the cash wage. From 2028 the minimum is adjusted for inflation each January, so check the current figure on your workplace poster.
Where to take unpaid overtime
Because the overtime rule is federal, so is the claim: a complaint to the U.S. Department of Labor's Wage and Hour Division, or a lawsuit under the Fair Labor Standards Act. Federal back pay generally reaches back two years, or three if the violation was willful. A claim for unpaid Florida minimum wage is different: state law requires written notice to your employer first, and gives them 15 days to pay before you can sue.
Working out your own pay
