Overtime rules in New York

At the $17.00 minimum wage in New York City, Long Island and Westchester, five 10-hour days pay at least $935.00: 40 hours at straight time and 10 at $25.50. New York counts overtime by the week, like federal law. Where it goes further is the salary a manager must earn before overtime stops.

Only the week counts

Overtime in New York is time and a half of your regular rate for every hour over 40 in the workweek. There is no daily overtime, so four 10-hour days are 40 hours at straight time, and each week stands alone: 50 hours followed by 30 is still 10 hours of overtime. One group waits longer. Residential employees, who live in their employer's home, are owed overtime only after 44 hours.

The salary line is much higher

Federal law lets an employer stop paying overtime to an executive or administrative employee on a salary of $684.00 a week. New York sets its own floor for those two exemptions: $1,275.00 a week in New York City, Long Island and Westchester, and $1,199.10 in the rest of the state in 2026. A salaried manager in Manhattan can earn $591.00 a week more than the federal line and still be owed overtime, whatever the job title says. The duties still have to fit an exemption too, and the professional exemption has no state salary floor, so the federal one applies there.

Where to take unpaid overtime

The state Department of Labor's Division of Labor Standards takes wage complaints on its LS 223 form. Going to court under New York's labor law reaches back six years, against two years, or three if willful, under federal law. Minimum wage rises with inflation from 2027, so check the current rate on the poster at work.

Working out your own pay

The calculator above applies the weekly rule to the hours you actually worked. If you are paid a salary, the exempt salary threshold page sets out the federal tests that sit under New York's. A week that mixes two rates or a bonus needs the blended rate calculator, and overtime laws by state shows the six states that add daily or other rules to the federal 40 hours.
